Can I Upgrade from Enterprise 32 bit to 64 bit on recent purchase

    Unless you have an MSDN subscription, I'm not aware of any legal ways to obtain Windows 10 Enterprise except through some kind of organizational licensing arrangement, as others have stated.

    I have contacted the seller and his comment is that I was sold a legitimate OS but it cannot be upgraded because it is no longer owned by an employee of the "university". He states that he feels secure in saying it was OK to sell me the laptop with it installed without notifying me that it was not his OS to sell.

    I recently cloned the hard drive and when installing the new drive it showed unactivated... So I am trying to see if this is pirating or just stupidity for buying a laptop with the operating system installed?

    Is it my understanding that in able to install Windows 10 Enterprise that Windows 10 Pro ( or other OS) should be installed . Should the seller furnish me with that COA?

    Volume Activation uses KMS (Key Management Service) or MAK (Multiple Activation Key).     Only way to go from 32 bit to 64 bit is a clean install which would automatically null and void any possible activation your 32 bit Windows 10 Enterprise laptop has. A freshly installed 64 bit Enterprise would need either contact the organisations key management server, or you would need to manually enter the MAK key which would be away from the license quota of the organisation owning that license.

    The Enterprise edition of Windows 10 on laptop you bought is not legit. This fact does not change, regardless of how many times or in how many different ways you ask it.

    Getting Windows 10 Pro installed and activated has nothing to do with getting Windows 10 Enterprise. It, as has been told to you multiple times can only be licensed through volume licensing, even when upgraded from a lesser edition of Windows 10.

    You mention Dell D830 as laptop model in your system specs. That's an almost 10 years old model which came shipped with Windows XP and later on with Windows Vista; if the COA sticker on laptop is still readable or the seller could find its information, you might get lucky and get an OEM product key for either XP or Vista. Upgrading either of them to Windows 7, 8, 8.1 or 10 would require a paid for upgrade license.

    However, that does not help you in any way to get free Windows 10. If you want a legal and valid, activated operating system on that laptop you have to buy one. Whatever OS you'll buy, remember this: if an eBay seller gives it to you with a nice low price, you will most probably end up as you started, with a counterfeit OS which might or might not work and activate. Those $10 Windows 7 or $25 Windows 10 licenses are not valid.

    If you can prove that the seller advertised the laptop for sale with Windows 10 provided then you will have to take the seller to court and get your money back for Windows 10. Full retail price. Your copy of Windows 10 is illegal for you to use. PERIOD. The EULA that the previous user agreed to for Windows 10 Enterprise has no provision in it for them to sell it. Both the Pro and Home Windows 10 EULAs have provisions for you to sell it.

    Thank you, it was my oversight for not knowing what the EULA stated , or didn't have a clause for, for the transfer of license I was buying with the computer.

    Yes I have the ad stating that it included the W10 Enterprise OS and the seller states he included a legal working OS that is still valid...

    I just wish that MS would have some proof source or at least make it more clear for W10 Enterprise and Education version users in regards to selling the license with a computer...

The provisions of this section do not apply if you acquired the software as a consumer in Germany or in any of the countries listed on this site (aka.ms/transfer), in which case any transfer of the software to a third party, and the right to use it, must comply with applicable law.
    a. Software preinstalled on device. If you acquired the software preinstalled on a device (and also if you upgraded from software preinstalled on a device), you may transfer the license to use the software directly to another user, only with the licensed device. The transfer must include the software and, if provided with the device, an authentic Windows label including the product key. If you acquired the software as stand-alone software (and also if you upgraded from software you acquired as stand-alone software), you may transfer the software to another device that belongs to you. You may use the backup copy we allow you to make or the media that the software came on to transfer the software. Every time you transfer the software to a new device, you must remove the software from the prior device. You may not transfer the software to share licenses between devices."

    Instead of asking the seller about it, I would suggest you ask Microsoft about it:
