If you read the EULA though it quite clearly says if you had a retail Windows 7 or 8 then you can transfer the resulting upgraded 10.

Before any permitted transfer, the other party must agree that this agreement applies to the transfer and use of the software.
b. Stand-alone software. If you acquired the software as stand-alone software (and also if you upgraded from software you acquired as stand-alone software), you may transfer the software to another device that belongs to you. You may also transfer the software to a device owned by someone else if (i) you are the first licensed user of the software and (ii) the new user agrees to the terms of this agreement. You may use the backup copy we allow you to make or the media that the software came on to transfer the software. Every time you transfer the software to a new device, you must remove the software from the prior device. You may not transfer the software to share licenses between devices.

Based on that I'm fully expecting to be able to transfer my Windows 10 that I upgraded from a retail version of 8. Will have to see of course but it seems pretty clear to me.

When you accept a promotional offer, you accept the terms, conditions and limitations of that promotional offer. The promotional offer was for Microsoft to upgrade existing devices with Windows 7/8/8.1 installed on them to Windows 10. It's like buying a manufacturer refurbished computer - you get a computer in a box sealed from the factory by the manufacturer, you pay less for it, but the terms and conditions of purchasing the refurbished unit state that you only get a 30, 60 or 90 day warranty instead of the full 1 year full retail warranty (for example). If you want something more than was offered in the promotion then you have to obtain it outside the promotional offer.

But, like I also posted, when you upgrade, call Microsoft for activation and see if they will activate it for free for you. You can file a claim against Microsoft using the terms and conditions stated in the EULA as a basis (or threaten to) and Microsoft will probably just give you a full retail product key for Windows 10 because it is cheaper for them to do so than to even participate in arbitration.

New motherboard = new device. You can install your retail license Windows 7/8/8.1 on it. You can also call Microsoft and hope they give you Windows 10 for it - but they never promised to for free after July 29th.

Lo and behold, this morning I found an extra (unused) Windows 7 Pro disk that I had laying around from goodness knows when! I'll install that bad boy and activate prior to upgrading to 10. I was getting ready to go buy one, since I'm getting the motherboard this coming week, but now I don't have to.

does this sound right ? should this then be ok for a Windows 10 upgrade ?
