Same problem with me, my download is at 10% after two days (truth be told, I tinker with WinX very little and only run it about a hour everyday, so its not a fair evaluation), but left it on all last night to speed the 10049 download and got nowhere fast There must be a awful big demand on Redmonds servers for that new Spartan browser!

You are missing the point, the title of this O/S is Evaluation.
You are using this O/S purely for your own benefit, toys for the boys or girls come to mind.
Perhaps a mixture of boredom or curiosity may have influenced you, but are of no benefit to M$ in the development of this O/S.
I'm not suggesting anybody do it, just stating that people do it. Sometimes a simple reg edit will get you a feature from the earlier build that you liked, versus a feature they changed that you don't like. You do it, then forget you did it, then wonder why you can't upgrade to the next build. For example, If I could easily switch to the Windows 8.1 Start Screen versus the current hybrid Start Screen/menu I would. So would others. It happens. There are other things that can cause issues, programs you've installed, drivers you've upgraded. Granted, going from one version of Windows 10 to another shouldn't be that big a deal. not like upgrading from Windows 8.1 to 10 would be. Me personally, I prefer a clean install when ever possible.
Ever since Windows for Workgroups 3.11 I have done clean installs when a new OS was released.
With Vista (after Win7 was released) I found that I could update a clean install of Vista to Win7 - but could not when trying to update my well-used version of Vista (this was on a Lenovo x61t tablet).
My Win8.1 install was an update from Win8 - and I had to fight with my Samsung laptop for over 4 months in order to get it to install.
I intend to try to install Win10 on top of my 8.1 today (after backing it up to my ext HDD and my WD MyCloud device)
I will do a clean install at RTM, but need to immerse myself in the OS prior to it's release (so I'm prepared to help others when it is released).
As for why I'm doing an update rather than a clean install right now, it's basically for 2 reasons:
1) To see how the update process works when going from 8.1 to 10
2) Because I'm lazy and I have many programs to install, and a customized program (for BSOD analysis) that will take some research and a couple of hours to install.
I've had a similar problem (it's a different error code) and I've followed
this guide and I solved it.
