Used to be that you could use the upgrade key, if you went from say Windows 8 Home to Windows 8 Pro.     I'm not sure if I totally understand your post? But, my laptop came with 8.0 Core, that's the OEM key in the BIOS. When I did my free upgrade it was running 8.1 Pro with my MSDN key. I got 10 Pro. It activated just fine also.
