Actually, to update, I have had 2 conversations with MS tech support, and both times they said that retail licenses maintain transfer rights after upgrading. It also states that in the EULA/MSLT that you agree to when installing.
Interestingly, when I asked if I had to first install the W7/W8.x before upgrading when I transfer to a new computer, they said I could use the specific ESD/ISO for that system and skip installing the qualifying OS first.

As you may know, I have been dealing with activation issues at EF quite extensively, and the new digital entiltlement has me in a tizz as well.
As we know OEM vs Retail refers more to support channels than transferability. The confusion is when OEM licences gets converted to digital entitlement (and Retail per se) - does it mean the OEM's relinquishes maintenance responsibilities?
My understanding is that the upgraded key maintains it's rights - thus the OEM key for Win7/8 will always be the respnsibility of the OEM - however as soon as that becomes retail via digital entitelment, MS assumes support.
In other words, transferability is maintained by the underlying key not by digital entitelment.
Sorry, if I sound like I'm rambling, just trying to makes sense of all this...

No, that makes sense, but the transferability of the OEM COA sticker key to any other virgin machine as digital entitlement and activate a freely available build 10565 ISO install is a splendid present!
Then, presumably the new virgin PC is good for Windows for life.
This upgrade model surely cannot continue, and makes the EULA terms for Windows 10 nonsense.

There are lots of loopholes, especially regarding Windows 7, obviously not up for discussion, but yeah, thus the need for OA3, which has closed it.
I doubt MS will now go back and close those win7 loopholes, I mentioned in a previous post that pirates are getting digital entilement, not only on Win 7 but Win 8 via KMS as well ...
What I'm a bit confused about is that MAK keys qualify for 'direct upgrade' as well (dunno if you saw the list of approved Win7/8 editions I posted)... a bit strange for a non-VL free upgrade. So many questions, so few answers.
