I would think, if Windows 8.1 is already installed, they could do the free upgrade online, or just leave it for whoever buys the PC. My guess is they'll leave it be if it already has a Windows 8.1 COA sticker on it. Then tell the owner they can upgrade for free if they want, maybe even offer to do it for them. Just guessing of course.

Quoting you, "when you turn in your license" not sure what that means. If MS wants a valid license key that you can supply (non oem) that would be great, but if MS is going to "take" the license key on the machine that you are currently running is a different situation for me. I am not "turning in" my current machine. The only alternative if this is true is to just flat out buy another license. Don't think MS mentioned any $$ yet? I have a couple of un-used keys from a tech net down load, probably they would not qualify?
There is no turning in a license. If you own a license retail or OEM of any editions of Windows 7 or Windows 8/8.1 then you are eligible for an upgrade to WIndows 10. Currently the only thing MS has talked about with Windows 10 is upgrades. They haven't mentioned new installs. You won't have to buy a Windows 10 license unless you have a PC with no OS (that includes Linux :), XP or Vista.

That depends on how one looks at it. If you use your key from your old OS to upgrade you will not be able to legally run both OS's. Hopefully MS will allow anyone who doesn't like Windows 10 to go back to their old OS.

    *Windows Offer Details

Windows 10 is a free upgrade, for a limited time, for qualified Windows 7 and Windows 8.1 devices (including devices you already own). It is our intent that most of these devices will qualify, but some hardware/software requirements apply and feature availability may vary by device. The availability of Windows 10 upgrade for Windows Phone 8.1 devices may vary by OEM, mobile operator or carrier. Devices must be connected to the internet and have Windows Update enabled. ISP fees may apply. Windows 7 SP1 and Windows 8.1 Update required. Some editions are excluded: Windows 7 Enterprise, Windows 8/8.1 Enterprise, and Windows RT/RT 8.1. Active Software Assurance customers in volume licensing have the benefit to upgrade to Windows 10 enterprise offerings outside of this offer. See here for details.
