Hi, do you mean the one that only appears when your pointer is over that area? I guess that's trying to show that's when it's applicable. If you move your mouse to the left of the menu, there's nothing to scroll there. Likewise the vertical scroll bar for the tiled region is only visible when you mouse over that. So at least the behaviour of these is consistent.
After that, it's whether that design choice appeals to you. If not, you could use a 3rd party start menu..
Everybody implements changes as they seem fit on their products, not only MS or even SW developers, that's nothing new. I don't think I have many products I didn't customize to at least some extent. Cars extensively, toasters not so much.
I'm not satisfied with Start menu either but I adapted it to my (almost) satisfaction. Problem would be if customization was impossible because only than I would have to go with what exactly was presented.
