If you're that concerned about sensitive data, secure erase the drive first, then update the FW.
Why would you want to do that? And Secure Erase isn't exactly a quick process. Then you'd have to turn around and re-image the drive? This would truly be the paranoid's slow route to getting things done when the update takes less than 30 seconds

Well, I did think of that but Samsung said that by LAW they remove all data before trying to fix any drive.

...and if you do a secure erase, how do you start Windows and run Magician...I guess I would need the ISO.

Only if you depend on only one machine.

    I'm insinuating time is money...

They may erase the drive, but that's not the same as removing the data... by "LAW"

Do you honnestly think they'll even take a look at that drive's data ?
Someone going to decide about whether or nor they're going to send a replacement and that's about it.
FW updates are at you're own risk as far as I recall.

Either way, you could just NOT update it ust the same. It's working fine, right ?

    Cheers,
As far as it working fine goes I am not sure. I have a Z97 based UEFI system I built about 2 1/2 years ago and the firmware on the SSD has not changed from EXM01. However, several times a month, it boots into Bios. I then tell it to save and it says I made no changes. It then reboots and it starts Windows...this is OK for a few more weeks. It is almost like there is a race condition and perhaps the SSD is not ready. Anyway, I just thought that going from EXM01 to EXM04 would be worth the try.

We're getting too serious here guys.

My question to Samsung's statement is not meant as an attack on the OP, but rather a question to the validity of such a statement by the company. The OP merely reported what was given to them.

You really are making this out to be more complicated than it is. That's the bottom line here.

Regarding your greater issue, where you say your PC randomly boots into the BIOS, be aware this could also be something else that has nothing to do with the drive itself. Yes, a failing drive will do this, but also a failing CPU, RAM, GPU or other hardware. It could also be a failing CMOS battery, or even a loose cable somewhere.

That said, if the drive needs a firmware update, get it done and move on from there. If your issues persists, look elsewhere, to also include the drive. Just because you did the firmware update doesn't mean it gets an automatic pass. It just means you don't have to worry it's a firmware issue.

We really are trying to help you here :)
