What was the warranty that you bought the card under? I don't know about the UK, but here you cannot change something after the fact. The warranty you bought the card under is in effect. They can change the rules, but only for items bought after the new rule was enacted.

If you happen to know an Attorney friend. Maybe if he was to send them a letter it may 'expedite' the resolution.

Mike, you are confusing Zotac's warranty and Ebuyer's warranty. In the UK, warranties are through the retailer, so I have been told.

I'm no legal expert but IMO you had not agreed to a refund - partial or otherwise - when eBuyer destroyed it... so it was and is still your card. (In many ways the 5-year warranty from Zotac is irrelevant here. It's the action of the company you had the initial supply contract here, i.e.Ebuyer.)

I suggest you email Ebuyer's managing director and ask him very nicely to confirm the correct postal address for registered mail. It's only fair that you explain that you need the information for what used to be known as the Small Claims court. Be polite and only state facts, not your opinion.

Read up on the process for Scotland here.

I've emailed CEO's many times before and - without fail - they have always helped, usually by instructing one of their staff.

    Hope this helps...

He is dealing with Ebuyer, Zotac has supposedly said they would replace it under warranty. His problem is with Ebuyer, not Zotac, at least that's the way I read it. Unlike us, we would return the card to the Manufacturer for a warranty claim after 10 months. He has to, for some reason, go through the Retailer. They supposedly replace the card and get reimbursement from Zotac. Ebuyer has, for reasons unknown, destroyed the card. So, he cannot go through Zotac now, his only recourse seems to be Ebuyer. I am just curious what right they had to destroy the card before any resolution was made.

I am also curious if they are trying to make a few extra pounds by prorating it when Zotac will reimburse the full price. Cards are expensive now days and hard to come by. Maybe a few shenanigans going on?

UK warranties legally enforceable for 12 calendar months and are the responsibility of the manufacturer but the retailer is legally obliged to deal with the customer at the point of sale for the first six calendar months.although some retailers handle all warrantees

There is also the proviso that the 12 months can be extended where it would be reasonable to expect a product to last for longer than this - Eg. A house or major modifications to a house would be expected to last for 20 years at least but this warranty is handled by trade bodies funded by the Trade, rather than direct by the trades themselves

The warranties on perishable goods (food) is governed by a separate regulation based on Use By or Best By dates of labeling

Also in the UK for online purchases you have the right to return at no cost for fourteen days from reciept.

    FYI @essenbe

It's the difference in consumer protection law here in the UK (with slight differences in process/terminology for Scotland).

    Hi,
Yep might just call back and ask for a supervisor instead of Laura :)

I had to get nasty with Corsair and finally got a followup from a supervisor on an rma :)

One proven method these days is the find the CEO's email address and ask them to sort it out, it is known to work especially when backed by a twitter campaign that is taken up by others
