W10 licence transfer. What happens if I change/upgrade my PC later on?

    The transfer rights of an upgraded retail license do not disappear if taking the free upgrade offer to Windows 10. There still remains the right for a retail license holder to transfer their copy of Windows 10 to a new device. This is the EULA section that applies to transferring Windows 10 for people who upgraded their retail copies of Windows:

    b. Stand-alone software. If you acquired the software as stand-alone software (and also if you upgraded from software you acquired as stand-alone software), you may transfer the software to another device that belongs to you. You may also transfer the software to a device owned by someone else if (i) you are the first licensed user of the software and (ii) the new user agrees to the terms of this agreement. You may use the backup copy we allow you to make or the media that the software came on to transfer the software. Every time you transfer the software to a new device, you must remove the software from the prior device. You may not transfer the software to share licenses between devices.

    Well here is another difference. I upgraded from a retail version of Windows 7 Home. If I got to the activation settings it offers me: and upgrade to pro:

    "Windows 10 Pro will be installed and licensed to one PC - this one."

    for $99.99

    I was expecting this to be transferrable as well. If It were, I would purchase it. Kind of bummed.

    Correct. And on July 30, 2016 the user will transfer their Windows 10 as a clean install onto a computer that has never had Windows 10 on it before and Microsoft will refuse to activate it with the transferred upgrade license. Then the user will be required to take the actions specified in Sections 10, 11 and 12 of the EULA.

    Not exactly.

    In this case, the user will have to first install Windows 7 or 8.1 onto their PC, then do an online upgrade through Microsoft's servers - which will work because the Windows 7 or 8.1 license will be authorized for the upgrade with Microsoft. After that, the new system hardware will be authorized with Microsoft's servers for Windows 10, and a clean installation of Windows 10 can be performed on that hardware.

    Doing this will deactivate the previous hardware that Windows 10 was associated with, and a user may have to call Microsoft support to activate the new hardware with Windows 10. Still, they will be able to transfer their Windows 10 license to new hardware beyond July 30th 2016.

    Microsoft do not consider the free promotional upgrade be the same as the upgrade described in the EULA. Their argument being that a promotion is exactly that...just a promotion. Phone them up. Speak to them. If you only argue your point on a public forum your upgraded Retail Win8.1 license will be considered a pre-installed Win10 license after July 29 2016, tied to the device.

    This issue has been beaten to death on these forums. A retail Windows 7 / 8.1 license that has been upgraded will be able to transfer beyond the free upgrade period, and still access the upgrade to Windows 10, through a convoluted process of first installing Windows 7 / 8.1, then upgrading online, then formating and performing a clean install.

    A promotion being a promotion doesn't change this. The promotion is to upgrade the license like-for-like to Windows 10.

    There are some differences between a store bought retail Windows 10, and a retail Windows 7 / 8.1 upgraded, in that a store bought retail Windows 10 will not need to go through the upgrade process on a new machine, but both will retain their ability to be reinstalled on a new PC beyond the free upgrade year.

    The promotion is a free year to upgrade, and not a free year to install.

    Which is all all you and WhyMe are, in this matter. The understanding that Windows 10 will continue to be accessible for retail licenses beyond mid-2016 comes from the information which Microsoft has supplied.

    There is nothing saying such, and indeed retail licenses will access Windows 10 just as easily as before after mid-2016. But believe as you will, it won't change the fact that people will be transferring upgraded Windows 7 / 8 -> 10 to new devices beyond mid-2016.
