I'll agree that we disagree. MS could have done better, but they aren't doing anything illegal. At worst they are taking advantage of peoples stupidity and propensity to click away at anything that pops up. BOTH are to blame if you actualy have to blame someone.

I personally, haven't accused them of doing anything illegal. Some in this tread have though. IMHO, its underhanded and of poor practice. The new GWX App change that this thread is talking about, doesn't bother me near as much as the OOBE update I stumbled on while researching the GWX change. That takes things to a whole new level of trickery.

Come this Wednesday I'll see for myself what actually happens from just clicking the RED X in the GWX App. I'm going to try and have my camera handy just in case the snipping tool isn't accessible.

I see in the UK someone has decided to take on Microsoft on legal grounds over this upgrade matter. In an email directed at Microsoft, the person concerned is stating they are prepared to challenge Microsoft under the UK Law, "Computer Misuse Act 1990". The person also believes it could be possible that the manner in which upgrades are being handled could be a contravention of UK Contract Law in relation to obligations associated with a previous software purchase.

So, MS may be well advised not to ignore the backlash from users all over the World.

I never actually said it was illegal on what Microsoft or other companies can do. I was just saying that the U.S. states have contract laws that could very by state and the FTC fines companies that use trickery. Nothing accusatory there to any company. If it sounded like I was doing that, it was just my opinion I was not accusing Microsoft or any company of any wrong doing.

My experience when installing or upgrading 10, the EULA agreement usually pops before the installation starts not after.

It will be interesting to see if @alphanumeric gets the EULA before the install starts. He should.

Well MS is definitely forcing you to upgrade from Win7. My neighbor who is running a business servicing vehicles asked me to check out his system to see if he could upgrade from Win7 to Win10. I said yes I would do that this weekend June 04. When he left his shop this past Friday he didn't get any popups or anything from MS wanting to upgrade to Win10. The shop was closed on all weekends. He opened his shop this morning and went into the office and moved the mouse to wake up the computer and was looking at a screen stating Windows 10 has already been installed. And if he wanted to revert back to Win7 it would take a while.
This is not good enough as to what MS is forcing a lot of people to do when they are not prepared. What would have happened if the system crashed on first reboot and he could not get into Win10. He would have been looking at hours of trying to get the system up for his business.
Microsoft please remove this forceful upgrade and allow us to upgrade when we are ready. The people at MS who made the decision to force these upgrades are not thinking about business people who rely on MS software to run their business and have to find the time to prepare for such a task. What a great Team you have there MS. lol

When people are Hidding their activity behind the Law , forcing the people, based on the EULA, to do thing they really don want, that are criminals. Do not let you make crazy with EULA. You have no choice, do you have? Whre it is?

You can refuse to agree to the terms of the EULA. You can say no. Windows will not install if you say no, but you do have a choice.

Given the way MS has been behaving, I wouldn't be surprised to discover that saying "No", just gets rid of the window temporarily.
The W10 installer will probably just keep popping up every few days.

Maybe your experiments will provide us with more information. :)

I'll know soon enough. The Scheduled install is midnight tonight. It's either Midnight or noon. I think it said 12 AM so that should be midnight. My plan is to just leave that PC on and logged in overnight. Then have a look see in the morning. I will be refusing the EULA, assuming there is one.

Then seeing what happens next. My guess is it will be wash rinse repeat. It is going to suck if it just goes to the next date in the list and prompts again. That's all assuming it doesn't crash and burn on the roll back.
