Would this work (gatherosstate) from an activated OEM W7 install disc (installed on its rightful PC) but with the OS simply quickly installed and activated but NOT updated or brought up to upgrade qualifying spec ?

As long as it is activated, yes. You don't need SP1 or any other patches/upgrades.

The requirement for SP1 on a 7 install is when planning to upgrade over the existing install to 10 where the service pack is a requirement. You are not seeing an upgrade but totally fresh clean install with the method here. The xml file itself is first recovered from the existing 7 OEM install you have on presently to be kept safe on a flash drive if not other drive until the clean install of 10 is on and then you place the file in the correct location.

Once done you should find 10 activated following the next start up. Some will immediately tend to the full restart to confirm all went well.

It's my understanding with the latest Win 10 version (ISO) a person can clean install Win 10 using a legitimate/qualified W7 or W8.1 product key.
That would save the time of installing the previous Windows version and then upgrading to Win 10.
I haven't done this, it's just my understanding from what I've read about the latest Win 10 version.

Perform a clean installation using a USB or DVD
Follow these instructions to perform a clean installation of Windows 10. If you want to upgrade to Windows 10 for free, follow the instructions in the Upgrade to Windows 10 using the tool section. If you haven’t upgraded to Windows 10 yet and perform a clean installation, you’ll need to enter a qualifying product key for Windows 7, Windows 8.1 or Windows 10 or buy a license in order to activate Windows 10. Click here for information on qualified editions.

If i'm mistaken, hopefully someone here will correct me.

SP1 on Windows 7 (and Windows 8.1) is only required to do the upgrade using Windows Update. You can upgrade non-SP1 Windows 7 and Window 8.0 to Windows 10 by running setup.exe for Windows 10 from within the previous operating system (setup.exe either on a Windows 10 USB/DVD or mounted Windows 10 ISO).

Many especially those who aren't tech orientated and would never have signed up for the Windows Insider Program won't know that and simply run the upgrade from within Windows by way of the WU. By this time however not many having 7 on for any period of time wouldn't already have SP1 on since it would have come automatically even following a recent fresh install of 7 since 7 is still seeing the extended support until 2020.

With the option provided by the guide however the need to upgrade is bypassed entirely for seeing a bug free 10 install go on fresh. On the two desktops here I have a pair of 10 VMs one Home and the other Pro both activated using 7 keys for the 10586 Insider Preview. Those were then upgraded over by the TH2 still being set to receive Insider builds. The TH2 when tried separately however didn't seem to want to accept any 7 key and where I suspected that might require a 10 key.

And booting live once the flash drives were updated does end up with a self contained 4 in 1 usb stick with the TH2 download while a 10 Pro dvd is the full version media with both 32bit and 64bit flavors. Caught a Black Friday deal on 10 Pro media to grab at a discount. Only saved about $80-!

    Thanks for the info folks.

You see, I'm asking all this because at some point I might try and give W10 another go on my main PC which is running W8.1. Whatever I do, I don't want to lose that at the moment as its a new clean install onto a new SSD. Now W8.1 was a retail copy I bought to replace W7 (the preinstalled OEM the PC came with) and it is that OEM disc I would use to quickly put W7 back to claim the free upgrade.

One very real problem (that you are all probably fed up of hearing) is that up until now, this PC has refused to install W10 in any workable form. So if I try again, then this time it will be onto an HDD that's taken down to unallocated space. A truly clean install.

I've been trying the Enterprise version of W10 on an almost 10yr old laptop and that's fine.

What I did here to avoid the System Reserved as well as 300mb space left at the back end of any drive was actually boot live from either Linux distro or GParted live cd still needing to get a small flash drive while I can just as well boot live from the 128gb recovery stick in order to see any drive partitioned and formatted before any planned OS install. The 10 installer is then pointed at the existing primary rather then seeing a drive with a pair of partitions.

For an SSD that might be the move for you to try there over simply trying to see the 10 installer create and format the primary 10 will be put on. The other option would be plugging it along side an existing OSed drive and see the new volume created on the SSD while in Windows if not booted from another live media like Partition Wizard to prep the drive ahead of time. The UEFI setting in the bios also has to be changed when 10 refuses to go since that is the hang up frequently seen.

That'll work. Just install 7, activate, get the xml file and then clean install 10. It is much faster and more reliable to clean install 10 than try to upgrade 7.

Like @DavidE said though if you clean install the latest version of 10 (10586) you can just put in the key from your Windows 7 COA sticker...

Just make sure whatever you do to install correct (home or Pro) version of 10.
IIRC 7 Pro and Ultimate --> 10 Pro, every other version of 7 --> 10 Home.
