    I found a solution which has worked and upgraded from windows 7 sp1 to windows 10 today.

    Instead of running regular setup,
    Browse to Local Disk (C:)> $Windows.~WS > Sources > Windows > Sources...

    Have Windows 7 sp1 and Windows 10 Build 10240 in dual boot.
