    The fact that you can't even get to the first screen of Windows 10 install suggests that the problem is not the hard drive partitioning. You might want to check in bios setup and see if there is a legacy or CSM boot mode and enable that. Sometimes you can only boot from DVD in legacy mode.

    Yes legacy is on [underboot/keyboard settings in bios?], i cant check the POST because of a toshiba splash that I can only disable by enabling 'fastboot' which in turn disables the ablility to boot from anything other than the HDD.

    Some Toshiba models have a hotkey boot device where pressing "C" immediately after power on button boots from the CD/DVD drive -
    others have a press "F12" as soon as the splash screen appears to offer a choice of boot options

    Any chance with either of these?

    I have the boot order as;
    1. ODD
    2. USB
    3. Network
    4. HDD

    But I HAD to do that to run the GPL disc in the first place so I dont see the issue. Legacy is on under boot/keyboard.

    The issue seems to be an unreadable bootable windows 10 setup DVD on your system only. You say it works on other systems - is it just readable, or does it boot them up?

    Can you burn a new disk with:

    Windows 10 Recovery Tools - Bootable Rescue Disk - Windows 10 Forums

    this software on - I think it fits on a CD-R. Ask a friend maybe?

    It will allow you to properly format your hard disk (I have found Gparted is a little funny with NTFS partitions, for instance after resizing a Windows partition, you need to run a startup repair), download the setup Iso for windows 10 to the disk, extract the setup\sources folder to the hard disk, and start a clean install, without having to boot from a Windows setup DVD. Since it runs in a Ramdisk, it does not need to be installed, and you can remove the disk once running, but you will need to know your Network setup details, unless you have ethernet wired-in and DCHP set up on your router.

    It may even be able to read, your unbootable windows 10 DVD on your system.

    Another thought - Have you tried different media - DVD+R, DVD-R, DVD-RW for example, perhaps the disk your Windows 10 is on is somehow not compatible with your drive for reading, like not finalized?

    If you can bout from Kyhi's recovery disc, when it is up and running, you can then swap discs and run setup.exe from the Windows 10 disc.

    okay heres whats happened:
    the kyhi disc runs and boots fine, for some reason the windows official disc wont read at all, not even registering as a disk in the drive *sigh*
    Ive used AOMEI to check for bad sectors (none) It does appear that the partition is unallocated, i dont know if this is a problem, I believe I set the last table as msDOS and left the partition type as <none> or whatever.
    I tried to download the win 10 iso from microsoft, but it just keeps hitting me with missing .dll's
    I tried to send the iso from my main pc to the laptop but it wont register being on a wired network.
    So I uploaded to iso to my GDrive on the pc, (which took almost 2 hours)
    Downloaded it on the laptop only to be hit with an error after 45 mins saying that theres no more space on the drive.

    the virtual drive X: only has 157MB total, so I split open the iso, grabbed the source and setup files as you said and repeated the process of sending them over to the laptop, but unfortunately the files are too large. even sending them over zipped has not proved fruitful so far.

    If "the partition is unallocated" - there is no partition, just unallocated space for one - you need to create a partition in that space, or extend another partition to fill that space.

    But you are getting somewhere!
